COLES LUCKY 8 PROMOTION

 

How To Enter

1.      Individuals must, during the Competition Period, spend $40 or more in one transaction at Coles, Coles Express (including petrol), Coles Online, Liquorland, Bi-Lo and/or Pick N Pay (“Participating Store”), which must include the purchase of any two (2) Participating Products (“Eligible Transaction”). The $40 spend excludes purchases of tobacco and related products in South Australia and Queensland. Upon making an Eligible Transaction, individuals will receive a Lucky 8 token (“Token”) containing a 7-digit unique code (“Unique Code”), In the event of running out of tokens, customers will still be provided with a unique code for entry into the prize draw.

2.      To enter the Prize Draw, individuals must then either: 

(i)         Send an SMS to 1999 3999, containing (i) the Unique Code found on the back of the Token; (ii) the last 6 digits of the barcode from any two (2) Participating Products and (iii) their Name in that order, separated by spaces. Example of correct Entry: 1234ABC 123456 123456 JOHN; or

(ii)       Go online to www.coles.com.au, follow the promotional link to the competition entry page, and accurately complete all required fields in the online entry form in full, including (i) the Unique Code found on their Token; (ii) the last 6 digits of the barcode from any two (2) Participating Products; and their contact details.

3.      All Participating Products will be clearly marked in each Participating Store and will be featured accordingly in the Participating Store catalogue (where applicable) subject to availability throughout the Competition Period.

4.      Entrants must retain all their Tokens, Participating Product barcodes/labels/wrappers and a copy of the proof of purchase receipt(s) dated during the Competition Period for all entries, and upon request, must surrender these to claim a Prize.

Terms and Conditions of Entry

5.      Information on how to enter and Prizes form part of these Terms and Conditions of Entry. Participation in this Promotion is deemed acceptance of these Terms and Conditions of Entry.

6.      The Promotion is only open to "Eligible Entrants".  Subject to clause 7, an "Eligible Entrant" is a person who (a) is an Australian resident; (b) is at least 18 years of age at the date of Entry if making an Eligible Transaction at a Liquorland store; (c) submits each Entry into this Promotion in accordance with Entry requirements; (d) enters this Promotion for himself or herself exclusively and not on behalf of any other person or group of persons, including any syndicate of persons; and (e) does not in any way tamper with the Promotion and/or the Entry process for the Promotion.

(i)         Without in any way limiting the foregoing, if the Promoter is of the opinion, acting reasonably, that a person has submitted an Entry to this Promotion as part of a syndicate or otherwise in any manner designed to increase the likelihood of the entrant winning a Prize, the Promoter may, in its absolute discretion, declare that all entries submitted by that entrant are invalid.  The Promoter incurs no liability to the excluded entrant for any loss or damage he or she may suffer if such a declaration is made.

7.      Employees of the Promoter and their immediate families, employees of the Promoter's related companies and their immediate families and employees of any agencies involved in this Promotion and their immediate families are ineligible to enter.

8.      Promotion commences on 28/07/2008 and final entries close and must be received by 23:59pm (AEST) on 24/08/2008 (“Competition Period”).

9.      Multiple entries permitted, subject to the following: (a) each Entry must relate to a separate Eligible Transaction at a Participating Store during the Competition Period; (b) each Entry must relate to a separate Unique Code; (c) each Unique Code may only be used once to enter; and (d) a maximum of 5 entries per mechanic (SMS and online) per person/household may be submitted each day.

10.  A maximum of one (1) Major Prize and/or Minor Prize only may be won per person/household (except for SA residents).

11.  The maximum cost of Entry via SMS is 55c including GST. The SMS Entry mechanic is only open to entrants with an SMS compatible mobile phone, permitting text messaging to the premium rate Promotional SMS number. It is recommended that all entrants check with their service provider before entering. The charges for each SMS will appear on your next mobile telephone bill and charges apply for each SMS, regardless of error or any other occurrence or omission. Minors should seek bill payer’s permission before entering. Any cost associated with accessing the Promotional website is the entrant’s responsibility and is dependent on the Internet service provider used.

12.  The use of any automated Entry software or any other mechanism or electronic means that allows an entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that entrant invalid. The Promoter may, in its sole discretion, disqualify all entries from, and prohibit further participation in this Promotion by, any person who tampers with or benefits from any tampering with the Entry process or with the operation of the competition or acts in violation of these conditions, acts in a disruptive manner or acts with the intent to annoy, abuse, threaten or harass any other person.

13.  SMS entries submitted via the Internet are not valid and will not be accepted.

14.  When an Entry is submitted via SMS, a reply SMS message will be sent back to the originating mobile phone to confirm receipt of Entry. If an SMS is sent with an invalid Unique Code, a reply SMS message will be sent back to the originating mobile phone to advise that the Unique Code is not recognized by the database. Response times may vary and are subject to network coverage and availability, Entry volume, the capacity of the SIM card inside the mobile phone and/or technical problems.

15.  The Promoter reserves the right, at any time, to verify and inspect the validity of entries and entrants (including an entrant’s Token, Participating Product barcodes/labels/wrappers, proof of purchase, identity, age and place of residence) and to disqualify any entrant who submits an Entry that is not in accordance with these Terms and Conditions or who tampers with the Entry process (including but not limited to tampering by way of use of techniques designed to avoid the payment of SMS costs). Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

 

16.  Incomplete, indecipherable or illegible entries will be deemed invalid. Unrecognized Unique Codes will not be accepted.

 

17.  The Promoter’s decision is final and no correspondence will be entered into.

 

18.There will be four (4) Prize Draws. Two (2) Major Prizes and fifty-six (56) Minor Prizes will be awarded in each Prize Draw. A Prize Draw will take place each Monday at 11am (AEST) on 04/08/2008, 11/08/2008, 18/08/2008 and 25/08/2008 at messagemedia Interactive, Level 22/385 Bourke Street Melbourne VIC 3000. Entries into each Prize Draw close at 11:59pm (AEST) on the day prior to each Prize Draw. The Winners in each Prize Draw will be notified by telephone and in writing and their name will be published in The Australian on 22/08/2008 (for Winners of Prize Draws on 04/08/2008 and 11/08/2008) and on 05/09/2008 (for Winners of Prize Draws on 18/08/2008 and 25/08/2008). All eligible non-winning entries in each Prize Draw will be entered into all subsequent Prize Draws.

 

 

Major Prize (“Major Prize”)

19.  The first two (2) valid entries drawn in each Prize Draw will each win an 8 day, 7-night family package for up to four (4) people (2 adults and 2 children under 14) to Daydream Island, valued at up to $21,710 (inc GST), which includes return economy airfares from the Winner’s nearest Australian capital city, return transfers between airport and hotel and breakfast daily. Each Major Prize also includes the following:

  • A family trip to  Whitehaven Beach on a super yacht for a day including full crew and private chef to prepare all meals
  • A whole day for the family in the spa to be pampered or to have a health assessment including a healthy family lunch
  • Your own personal Daydream Island activities team for a day - learn to snorkel, feed the sharks, stingrays, bushwalk, play tennis and minigolf PLUS a family portrait taken by the island's professional photographer,  a half hour jet ski session and  to  finish the day , a sunset cruise 
  • Learn about the Barrier Reef from your very own Marine Biologist -  Daydream Island's yours exclusively for the day -  for a sightseeing tour to the Reef with a difference
  • Fly to a remote island for a family  BBQ organised by Daydream Island Chefs   
  • Bring your favourite family movie to be screened on the Big Screen - just for you - with a family dinner and snacks

(a)  Other than where specified, the Major Prize does not include any additional meals, spending money, transfers or items of a personal nature, insurance, in-room charges, telephone, in-room video, mini-bar or other incidentals or ancillary costs. All such costs are the responsibility of the Winner.

 

(b)  Airfare conditions and fees will be advised at time of booking. Frequent flyer points will not form part of the Major Prize. The Major Prize must be taken as a single trip booked by the Promoter.

 

(c)   All travel must be taken and completed within 12 months of Major Prize Draw claim date. Travel restrictions apply during Easter, Christmas, and school holiday periods.

 

(d)  Major Prize values are in Australian dollars.  Winner may be required to present a credit card at time of accommodation check in. Accommodation can be extended at the Winner’s discretion, at an additional cost to the Winner, subject to availability and supplier’s standard Terms and Conditions. Surcharges may apply.

 

(e)   If the Major Prize (or any part thereof) is unavailable at or during the time selected by the Winner, the Major Prize cannot be taken on the chosen date and a new date must be selected, subject to flight and/or accommodation availability.  The Promoter is not obliged to reimburse the Winner of the Major Prize if they are unable to travel on the dates specified, for any reason whatsoever.

 

(f)     Subject to the Terms and Conditions of the participating Major Prize provider(s), if for any reason a Winner does not, once the Major Prize has been booked, take the Major Prize or an element of the Major Prize at the time stipulated, then the Major Prize or that element of the Major Prize will be forfeited and will not be redeemable for cash. No changes can be made to travel arrangements once tickets are issued.

 

(g)  If the Winner of the Major Prize is under the age of 18 years at the time of claiming the Major Prize, they must be accompanied by a parent/nominated guardian at all times. 

 

(h)   All parts of the Major Prize are subject to availability and can be withdrawn or varied by the Promoter without notice. The Promoter is not liable for any change to the itinerary or any other aspect of the Major Prize before or during the trip arising as a result of any circumstances whatsoever.

 

(i)     It is the Major Prize Winner’s responsibility (and any travel companions) to ensure they have all their relevant travel documentation. Compliance with any health or other government requirements at the destination is the responsibility of the Major Prize Winner (and any travel companions).

 

(j)     The value of the Major Prize is accurate at the date of commencement of the Promotion. The Promoter accepts no responsibility for any variation in the value of the Major Prize after that date.

 

(k)   Total Major Prize is valued at up to $173,680.00 (inc GST).

 

 

Minor Prize (“Minor Prize”)

20.  The next fifty-six (56) valid entries drawn in each Prize Draw will each win an Acer Aspire notebook (Model 5315-201G08Mi), valued at RRP $699 each (inc GST). Each Minor Prize Winner will receive a redeemable voucher (“Voucher”) to take into their nearest Officeworks store to collect their Minor Prize. Software packages and/or accessories or peripherals are not included and the Minor Prize is subject to availability at each Officeworks store. Total Minor Prize is valued at RRP $156,576.00 (inc GST).

 

21.  Total Prize pool is valued at up to RRP $330,256.00 (inc GST).

22.  Minor Prize Vouchers will be delivered to the Winner within 28 days of the Winner being determined by the Promoter. Once the Minor Prize Voucher has left the Promoter's premises, the Promoter and its associated agencies, and companies associated with this Promotion will take no responsibility for any delay, damage to or failure of safe delivery, of any Minor Prize Voucher.

 

23.  If any Major Prize Winner is under the age of 18 years at the time of claiming the Major Prize, the Major Prize will be awarded to the Winner's nominated parent or guardian.

24.  The value of all Prizes is accurate at the date of commencement of the Promotion. The Promoter accepts no responsibility for any variation in the value of the Prizes after that date.

25.  Prizes, including any unused portion of any Prize, are not transferable or exchangeable and cannot be redeemed as cash. 

26.  Any costs in excess of the (GST inclusive) value of the any Prize and all ancillary costs associated with redeeming the Prize are not included and are the sole responsibility of the Winner.

27.  The Promoter reserves the right to conduct such draws as are necessary at the same time and place as the original draw on 28/11/2008 to distribute any Prizes which remain unclaimed by that date subject to any written direction given under clause 37 of the Lotteries and Gaming Regulation 1993 (SA). Winners will be notified by telephone and in writing and their name will be published in The Australian on 18/12/2008.

28.  All Prizes must be claimed by 02/03/2009. In the event that, for any reason, a Winner of any Prize does not claim their Prize by this date, the Prize will be automatically forfeited by the Winner and cash will not be awarded in lieu of the Prize.

29.  If any Prize (or any part thereof) is unavailable, the Promoter, in its discretion, reserves the right to substitute the Prize (or any part thereof) with a Prize of equal value and/or specification, subject to any written directions from a State and/or Territory regulatory authority.

30.  Images of Prizes used in any Promotional advertising material are for illustrative purposes only.

31.  If a Prize has already been awarded, but the Promoter determines that the Winner was in breach of these Terms and Conditions of Entry upon entering this Promotion, the Promoter reserves the right to request the Winner to return the Prize, or its monetary equivalent (at their own cost). Each Entrant acknowledges this condition upon entering this Promotion

32.  The Promoter, and any of its employees, contractors and agents or employees of its contractors and agents, reserves the right to refuse to allow a Winner or any/all companions to take part in any or all aspects of the Prize, if the Promoter or the team determine, in their absolute discretion, that a Winner is not in the mental or physical condition necessary to be able to safely participate in the Prize. The Winner and their companions may be required to sign a legal release and/or other documentation in a form determined by the Promoter in its absolute discretion.

33.  All winning entries will be entered into a database.  The Promoter may use the Winner's full name, likeness, image and/or voice and any other details for any Promotional, marketing and publicity purposes in any media worldwide without any fee being paid to the Winner.

34.  Promotional materials/products are void if stolen, forged, mutilated or tampered with in any way.

 

35.  The Winner accepts its Prize at its own risk. To the full extent permitted by law neither the Promoter, and/or any of its employees, contractors and agents or employees of its contractors and agents, and companies providing Prizes for the Promotion, will not be held liable for any liability/loss/damage/expense/death/personal injury suffered or incurred or any dispute (including, but not limited to, direct/indirect/consequential loss) arising out of, or in connection with, this Promotion, the provision of Prizes, use or participation in such Prizes or Promotion of this competition.

 

36.  The Promoter and any of their employees, contractors and agents or employees of its contractors and agents, accept no responsibility for late, lost or misdirected entries or an invalid Unique Code. All entries are deemed to be received at the time of receipt in the Promotional database and NOT time of transmission by the entrant.

 

37.  The Promoter, and any of its employees, contractors and agents or employees of their contractors and agents, accept no responsibility for any tax implications that may arise from the Prize winnings. Independent financial advice should be sought by Winners. The Promoter and its related bodies corporate make no warranties and accept no liability in relation to any Prize, its condition or fitness for any purpose.  All warranty claims should be directed to the manufacturer of the Prize. 

 

38.  The Promoter and any of its employees, contractors and agents or employees of its contractors and agents, is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to entrants or any other persons computer or mobile handset related to, or resulting from, participating in this Promotion.

 

39.  If for any reason the Promoter, and any of its employees, contractors and agents or employees of its contractors and agents, determines in good faith and its sole discretion that this Promotion is not capable of running safely as planned, including but not limited to events such as infection by computer virus or bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter, including but not limited to vandalism, power failures, tempests, natural disasters, acts of God, civil unrest and strikes, which might corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right and may in its absolute discretion cancel or postpone the Promotion and recommence it on similar Terms and Conditions, subject to State and/or Territory regulations.

 

40.  All entries become and remain the property of the Promoter and will not be returned. Upon Entry into this competition, the Promoter will collect personal information about you so that you can participate in the competition and the Promoter can administer the competition. To do this, the Promoter will disclose your personal information to organisations to which the Promoter outsources functions, and organisations associated with this competition. The Promoter may use this information, in any media for future Promotional, marketing and publicity purposes without any further reference, payment, or other compensation to the entrant, including sending the entrant electronic messages. If you are a Winner, the Promoter will disclose your first initial, surname and suburb or city of residence and State of residence to the media, who will publish these details.  If you do not provide your personal information upon Entry, you cannot participate in the competition. Access to personal information may be requested by contacting the Promoter.

 

41.  The Promoter is bound by the National Privacy Principles in the Privacy Act 1988.

 

42.  Should an entrant’s contact details change during the Promotional Period, it is the entrant’s responsibility to notify the Promoter.

 

43.  Each Eligible Transaction made at a Liquorland store is subject to each store’s liquor serving policy. The Promoter supports responsible service of alcohol and Entry and participation in this Promotion is subject to this policy. The Promoter encourages consumers of a legal drinking age to enjoy alcohol in moderation as per the National Health and Medical Research Council Australian Alcohol Guidelines - Males: up to 6 standard drinks on any one day, no more than three days per week; and for Females: up to 4 standard drinks on any one day, no more than three days a week.
